A BRIEF OVERVIEW OF THE ENVIRONMENTAL IMPACT ASSESSMENT REGULATION

Abstract


ABSTRACT

Environmental protection is secured by the constitution with the advent of the provision of article 56 in Turkish constitution dated 1982 stating that “it is the obligation of the Government and the citizens to improve the environment, to preserve the environmental health and to prevent environmental pollution”. In order to specify the procedure and principles of this assurance, Environmental Law no 2872 was put into effect in 1983. It was determined that of all the activities planned to be executed as per article 10 of the abovementioned Law, the ones which might cause environmental problems have to receive an Environmental Impact Assessment Report (EIA Report).

A regulation was issued by the ministry on several dates, with the purpose of regulating administrative and technical procedures and principles to be followed during environmental impact assessment. The most recent regulation was put into effect on October the 3rd, 2013 and it ensures a public participation in the approval of projects by governmental bodies, governmental institutions and by private enterprises.

This work analyzes the principles and procedures of this most recent regulation dated October the 3rd, 2013 in details - which is the last of the regulations modified and updated during the adaptation period to the environment legislation internationally applied.
